1. ACCEPTANCE OF TERMS​

By accessing or using the Youth Mental Health Canada (YMHC) Crisis Resources Directory (the "Directory"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not access or use the Directory.

2. NATURE OF SERVICE​

2.1 Informational Purpose Only​

The Directory is provided solely for informational purposes. It serves as a compilation of third-party crisis resources and support services. YMHC is not a crisis service, does not provide crisis intervention, mental health counseling, medical advice, or emergency services of any kind.

2.2 No Professional Relationship​

Use of the Directory does not create any professional relationship (including but not limited to counselor-client, physician-patient, therapist-client, or any fiduciary relationship) between you and YMHC, its directors, officers, employees, volunteers, or contractors.

3. CRITICAL DISCLAIMERS​

3.1 Emergency Situations​

IF YOU ARE EXPERIENCING A MENTAL HEALTH CRISIS OR EMERGENCY:

  • Call 9-8-8 (Suicide Crisis Helpline) immediately
  • Call 9-1-1
  • Go to your nearest hospital emergency department
  • Contact a local crisis service listed in this Directory

DO NOT RELY ON THIS DIRECTORY AS YOUR SOLE MEANS OF OBTAINING EMERGENCY ASSISTANCE.

3.2 No Endorsement​

Inclusion of any resource, organization, or service in the Directory does not constitute an endorsement, recommendation, or guarantee by YMHC regarding the quality, effectiveness, reliability, safety, or appropriateness of such resource. YMHC makes no representations regarding the credentials, qualifications, or competence of any third-party service providers.

3.3 No Verification​

YMHC has not independently verified the accuracy, completeness, currency, or reliability of the information provided by third-party resources listed in the Directory. Users are solely responsible for evaluating the suitability and safety of any resource before accessing or using it.

4. LIMITATION OF LIABILITY​

4.1 Disclaimer of Warranties​

THE DIRECTORY AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR RELIABILITY.

4.2 Exclusion of Liability​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YMHC, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "YMHC PARTIES") SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

a) Personal injury, emotional distress, or death;
b) Loss or damage resulting from use of or inability to use any third-party resource;
c) Failure of any third-party service to provide adequate care;
d) Delays in accessing information or services;
e) Errors, omissions, or inaccuracies in the Directory;
f) Any reliance placed on information in the Directory;
g) Any harm arising from contact with third-party service providers;
h) Technical failures, interruptions, or unavailability of the Directory.

4.3 Limitation on Damages​

IF, NOTWITHSTANDING THE FOREGOING, YMHC IS FOUND LIABLE FOR ANY LOSS OR DAMAGE, YMHC'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED TWENTY-FIVE CANADIAN DOLLARS ($25.00 CAD).

5. USER RESPONSIBILITIES​

5.1 Independent Judgment​

You are solely responsible for exercising your own judgment in using the Directory and determining the appropriateness of any resource for your specific situation. You must independently verify information and assess the suitability of any service provider.

5.2 Seeking Professional Help​

You acknowledge that the Directory is not a substitute for professional mental health care, medical advice, diagnosis, or treatment. You are responsible for seeking appropriate professional assistance from qualified healthcare providers.

5.3 Assumption of Risk​

You acknowledge and accept all risks associated with using the Directory and contacting third-party resources, including the risk that information may be outdated, incomplete, or inaccurate.

6. THIRD-PARTY CONTENT AND SERVICES​

6.1 No Control​

YMHC does not control, and is not responsible for, the content, policies, practices, actions, or omissions of any third-party organization, resource, or service listed in the Directory. Links to external websites are provided for convenience only.

6.2 Third-Party Terms​

Your use of third-party resources may be subject to separate terms and conditions, privacy policies, and other agreements between you and those third parties. YMHC is not a party to any such agreements.

6.3 Changes to Third-Party Services​

Third-party resources may change their contact information, services, availability, or eligibility criteria without notice. YMHC is not responsible for notifying users of such changes.

7. INFORMATION ACCURACY​

7.1 No Guarantee​

While YMHC endeavors to maintain accurate and current information, we make no guarantee regarding the accuracy, completeness, timeliness, or reliability of any information in the Directory. Information may become outdated without notice.

7.2 User Reporting​

If you identify inaccurate or outdated information, you may report it to YMHC at admin@ymhc.ngo, but YMHC assumes no obligation to investigate, verify, or update such information within any specific timeframe.

8. INDEMNIFICATION​

You agree to indemnify, defend, and hold harmless the YMHC Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

a) Your use of the Directory;
b) Your violation of these Terms;
c) Your contact with or use of any third-party resource;
d) Any misrepresentation or breach of warranty made by you;
e) Your violation of any rights of another person or entity.

9. MODIFICATIONS AND AVAILABILITY​

9.1 Right to Modify​

YMHC reserves the right to modify, suspend, or discontinue the Directory (in whole or in part) at any time without notice or liability. YMHC may also modify these Terms at any time by posting updated Terms on the Directory.

9.2 Continued Use​

Your continued use of the Directory after any modifications constitutes acceptance of the modified Terms.

9.3 No Guarantee of Availability​

YMHC does not guarantee that the Directory will be available at all times or that it will be uninterrupted, secure, or error-free.

10. PRIVACY AND DATA​

Use of the Directory may be subject to YMHC's Privacy Policy. By using the Directory, you consent to the collection and use of information as described in the Privacy Policy.

11. INTELLECTUAL PROPERTY​

All content, design, graphics, compilation, and other materials in the Directory are the property of YMHC or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws. Unauthorized use is prohibited.

12. JURISDICTIONAL ISSUES​

12.1 Canadian Resources​

The Directory focuses primarily on Canadian resources. Information may not be applicable or available in other jurisdictions.

12.2 Provincial Variation​

Mental health services and crisis resources vary significantly by province and territory. Users are responsible for determining which resources are available and appropriate in their location.

13. SEVERABILITY​

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT​

These Terms, together with YMHC's Privacy Policy, constitute the entire agreement between you and YMHC regarding the Directory and supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral.

15. NO WAIVER​

YMHC's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless in writing and signed by an authorized representative of YMHC.

16. GOVERNING LAW AND JURISDICTION​

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of Ontario for resolution of any disputes arising from these Terms or your use of the Directory.
